The Building Inspector is the chief official or authorized deputy responsible for enforcing the provisions of the 1935-miami-dade-building-code within the city-of-miami (p. 36).
Powers and Duties
The Building Inspector is granted the power of a Police Officer to enforce the code, including the authority to enter any building or premises for inspection upon presentation of credentials (p. 29). Key duties include:
- Inspections: Conducting or causing inspections at various intervals during construction, including foundation, frame, stucco, and final inspections (p. 26).
- Permit Management: Issuing building permits and maintaining permanent accounts of fees collected (p. 25).
- Certificates: Issuing building-permit-process Certificates of Occupancy and Certificates of Compliance (p. 28).
- Enforcement: Ordering work to stop, vacating unsafe buildings, and condemning structures that are dangerous or damaged by more than 50% of their value (p. 29).
- Fire Zone Regulation: In fire-zones No. 1 and No. 2, the Building Inspector has the authority to issue special permits for temporary buildings, such as reviewing stands, sheds, canopies, or fences used for public protection during construction work. These structures must conform to code requirements and be completely removed upon the expiration of the time limit specified in the permit (p. 105, 107). Additionally, the Inspector determines if changes, alterations, or repairs to the interior of existing Type IV or V buildings in Fire Zone No. 1 increase the fire hazard (p. 105).
Interaction with Other Entities
- Registered Inspector: The Building Inspector approves, registers, and assigns registered-inspectors for Type I buildings or complex designs. The Registered Inspector must obtain a Certificate of Registration from the Building Inspector and deposit a surety bond (p. 27).
- Board of Examiners and Appeals: The Building Inspector serves as an ex-officio member and Secretary to the board-of-examiners-and-appeals, though they do not vote on questions before the Board (p. 32).
Authority
The Building Inspector has the authority to approve alternate materials and types of construction if evidence supports their sufficiency (p. 31). If an applicant disagrees with the Inspector’s refusal, they may appeal to the Board of Examiners and Appeals (p. 32).
