The board-of-appeals is a three-member board established by city-of-miami Ordinance No. 1678, adopted in January 1937 (p. 321). It consists of the building-inspector and two other members appointed by the City Manager, who must be Master Builders, Structural Engineers, or Architects with at least ten years of experience (p. 321).
The Board’s primary function is to hear appeals from individuals, firms, or corporations dissatisfied with decisions made by the building-inspector regarding the condemnation of buildings or structures (p. 321). Appeals must be filed within five days of the Building Inspector’s final decision, and the Board’s decision is final (p. 321). The Board has the authority to establish rules for the time and place of hearings, with expenses borne by the City of Miami (p. 321). This body serves as a key component of the code-enforcement-mechanisms within the 1935-miami-dade-building-code.
